PRIVACY POLICY AND TERMS AND CONDITIONS OF USE OF THE PSIT DIGITAL PLATFORM
These terms and conditions create a contract between you and HSD Consultoria de RH Ltda. ("PSIT"). In order to confirm your understanding and acceptance of this agreement, click on "I Accept Contract". If you have any questions or suggestions, please contact HSD at faleconosco@psith.com. By starting using PSIT you do accept all the terms and conditions of this Agreement.
INTRODUCTION
1.1. The PSIT is a company that provides a digital platform for Perception Mapping applied to a group of people; such emissions of perceptions as well as the receipt of them is absolutely optional without any participant commitment or obligation. The participation choice is set on the platform's home screen ay first access.
1.2. The reading of the received perceptions is very personal, what means, it´ll only be visualized by the respective user analyzed and therefore is not, in any way, transparent to the organization at any level and under any circumstance.
1.3. It will be made available to the organization to read the collective and combined perceptions only received by a group of people or universe never less than 5 (five), thus guaranteeing total anonymity.
1.4. A list with the members´names who were informed by the organization as potential participant but have refused to participate will be informed nominally back to the organization. This is the only and exclusive situation that the contracting company will receive individualized information from the PSIT.
1.5. In the searching screen, the name of those who have refused to participate will appear shaded with no option to be selected.
1.6. The PSIT will never be held responsible for promotions as well as any layoffs as it does not provide the individual performance data back to the company, therefore, it disclaims any responsibility, at any level, of any business decisions.
1.7. PSIT reserves the right to change the terms and conditions of this Agreement at any time, without prior notice, by providing a revised version on the PSIT digital platform. Any new revised version will become effective as soon as it becomes available.
1.8. Continued use of the products and services, authorized by the PSIT, by the User after the entry into force of a new revised version of this Agreement will automatically imply full knowledge and acceptance by the User of all its terms and conditions.
1.9. The PSIT shall have the right to terminate, suspend or limit access to its account at any time without the obligation to keep or file the data on the received perceptions, whether individual or collective.
USERS
2.1. To be registered at PSIT platform you must belong to an organization that will formally contract PSIT for a period of time. This company will list people´s names who must be registered in this organization, and these will have their data (e-mail, registration or enrollment) inserted in the system. At the moment of the registration you will be asked to inform some additional data that will be confronted with those that the contracting company provided, such personal information is a safe measure to validate your profile, avoid duplicate registrations, preserve your privacy and ensure the quality of the entire service offered by our application and so are required.
2.2. The use of services and access to the PSIT requires password and login access. Your login and password are valuable, and you are responsible for maintaining your confidentiality and security. PSIT is not responsible for any loss resulting from the unauthorized use of your login and / or password. In the event you suspect that your login and / or password have been compromised, contact the PSIT immediately at faleconosco@psith.com.
2.3. It is your duty to keep your data up to date on the PSIT. In the event that such information is not correct, PSIT shall not be liable for any failure to communicate between the PSIT and you, and the PSIT may at any time limit or suspend your access to the platform without liability for the storage of the information.
2.4. If your perceptions information becomes public, or for any reason including racketeering, the PSIT will never be held liable or included in any court action. Acceptance of this term as well as acceptance of participation in the process of issuing and receiving perceptions represents its pure and exclusive science of such risk.
PSIT LICENSE
3.1. PSIT grants you a non-transferable, non-exclusive, non-sublicensable license to the PSIT platform. The PSIT license does not include any rights over the source codes or any tool or system employed in the development of the PSIT. The granting of this license shall not be understood as granting the right to the User or to any third party, regardless of the reason, access, although partial, to PSIT source codes.
3.2. The PSIT is available for Apple smartphones: IPhone 5, 5c, 5s, 6, 6 Plus, 6s, 6s Plus, 7, 7 Plus, 8, 8 Plus and X with the IOS 8 operating system or a newer version, and third-party smartphones in addition to the Android operating system with at least the Jelly Bean version 4.2.x, API level 17. Equipment that although compliant with the above specifications may not work properly if the device does not have physical memory or space in it or sufficient free disk for the application.
PERSONAL INFORMATION
4.1. PSIT may collect and store information provided by you when using the PSIT digital platform, including, but not limited to, information entered in an online form, provided by authorized third parties, added to your account, or provided by telephone contact.
4.2. The PSIT will use the information of perceptions received on you, always anonymously: (i) to process analyzes of trends and collective behaviors, being able to issue reports to the contracting organization that is never inferior to a population of 5 (five) persons, thus guaranteeing their total anonymity (ii) group such information for periods of time, or persons of the same position, from the same business unit, from the same directorate, management or coordination making available to the contracting organization ever lower than a population of five (5) persons. ) develop individual and collective behavioral tips that will be made available to you as well as to the contracting organization always with a positive bias towards improving individual and collective performance.
4.3 The PSIT will never be held liable for the adoption, either of the individual or of the organization, of the tips of individual and collective behavior emitted by the digital platform of the PSIT, being therefore of absolute and exclusive free will and criterion the adoption of such practices in any situation any time. The issuance of such tips does not represent the accountability of the PSIT digital platform for eventual promotions, layoffs as well as increase or decrease of the contracting organization's operational and financial performance.
4.4. PSIT will not sell or otherwise provide your personal information to third parties for marketing purposes. However, we may combine your information with other information to conduct behavioral studies. Such studies may be made available to third parties, without their prior consent, as long as it is not possible to identify their identity and personal data.
GUARANTEES AND RESPONSIBILITIES
5.1. PSIT does not guarantee, represent or warrant that the use of the PSIT digital platform will be interrupted and error free, and that the PSIT may remove services for indefinite periods of time, or even cancel the PSIT digital platform at any time, upon prior notice of 30 (thirty) days.
5.2. The services of the PSIT digital platform may be unavailable for an indefinite period, and the PSIT shall not be liable in any way.
5.3. The PSIT is provided by the copyright holders and their co-workers "as is", and they make no express or implied warranties, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Under no circumstances, shall copyright holders or their employees be liable for any direct, indirect, consequential, incidental, special, incidental or penalties damages in any liability, whether contractual, objective or civil (including negligence or otherwise), which in any way from the use of this application, even if it is advised of the possibility of such damages.
5.4. PSIT does not represent or warrant that the PSIT digital platform will be free from loss, defects, attacks, viruses, interference, hacking or other security intrusion, and PSIT shall not be liable for such acts.
5.5. You agree to indemnify and hold the PSIT platform, its shareholders, directors, employees, affiliates, agents or service providers harmless from any claims arising out of misuse of the PSIT digital platform and / or breach of this Agreement.
BRANDING PROTECTION
6.1. The name "PSIT" and logo are registered trademarks and may not be copied, imitated or used, in whole or in part, without the prior written permission of PSIT, except when in accordance with any permissive contractual agreement. In addition, all headers, custom graphics, icons, and scripts are trademarks of PSIT, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of PSIT.
GENERAL PROVISIONS
7.1. This
Agreement constitutes the entire agreement between you and PSIT and replace and supersedes any prior understanding of the same subject matter, as well as prevailing over any other statement of intent.
7.2. Should any part of this Agreement be deemed invalid or not applicable, such party shall be deemed invalid or unenforceable, with all other provisions of the Agreement remaining in full force and effect.
FORUM
8.1. The jurisdiction for the knowledge, processing or judgment of any judicial, administrative or extrajudicial action shall be the forum of the county of São Paulo, renouncing the party against any other, however privileged it may be.
